Welcome to Linkzly (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our Mobile Measurement Partner (MMP) platform, including deep links, Apps, mobile attribution analytics, deferred deep linking, app install tracking, integrations with third-party analytics tools, webhooks, app distribution, push notifications, and related mobile measurement services.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. These Terms apply to all visitors, users, and others who access or use the Services.
We may update these Terms from time to time. Your continued use after changes constitutes acceptance. It is your responsibility to review these Terms periodically.
1. Acceptance of Terms
By creating an account, using the Services, or otherwise interacting with Linkzly, you represent that:
- You are at least 18 years old or the age of majority in your jurisdiction.
- You have the legal capacity to enter into these Terms.
- You agree to comply with these Terms and all applicable laws and regulations.
If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Linkzly provides a comprehensive Mobile Measurement Partner (MMP) platform for:
- Creating and managing deep links with intelligent platform-aware routing (iOS, Android, web) and attribution tracking
- Configuring Apps with mobile attribution, Universal Links, App Links, and deferred deep linking
- Multi-method mobile attribution including Android Install Referrer, Apple SKAdNetwork, and probabilistic fingerprinting
- Real-time attribution analytics powered by ClickHouse, including app installs, clicks, geolocation, device info, and campaign performance
- Mobile SDKs for iOS, Android, React Native, Web, Unity, Unreal Engine, PlayStation, and Xbox
- Integrating with analytics platforms (GA4, Mixpanel, Amplitude, Segment, Facebook Conversions API) and custom webhooks
- URL shortening with custom domains and QR code generation
- App distribution for iOS (IPA) and Android (APK) builds
- Push notifications across iOS APNs, Android FCM, and Web Push
- Managing custom domains, teams, and user permissions
- Privacy-compliant attribution modes: strict, consent-based, and privacy-preserving
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.
3. User Accounts & Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials, including password and two-factor authentication (2FA/TOTP) codes.
- Notify us immediately of any unauthorized access or security breach.
- Be solely responsible for all activities under your account, including API key usage.
We may suspend or terminate your account if we suspect any violation of these Terms or for any other reason at our discretion.
4. Subscriptions & Payments
Linkzly offers Free, Starter, Professional, and Enterprise plans. Paid plans are billed monthly or annually via Stripe.
- Billing: You authorize us to charge your payment method for applicable fees. All payments are non-refundable except as required by law.
- Upgrades/Downgrades: Plan changes take effect at the end of your current billing cycle.
- Taxes: You are responsible for any applicable taxes.
- Cancellation: You may cancel anytime, but no refunds for partial billing periods.
- Free Trials: Trials may require payment details and auto-convert to paid plans unless canceled before the trial ends.
We may change pricing with notice. Continued use after changes constitutes acceptance of new pricing.
5. User Content & Conduct
You retain ownership of any content you submit, such as mobile app configurations, deep links, attribution parameters, custom short codes, deep linking paths, or webhook configurations (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display it as necessary to provide the MMP Services.
You agree not to:
- Use the Services for illegal purposes, including spam, phishing, or malware distribution.
- Create links or QR codes that violate third-party rights (e.g., trademarks, copyrights).
- Overload or disrupt the Services (e.g., excessive API calls beyond rate limits).
- Reverse engineer, decompile, or attempt to extract source code from the Services.
- Use automated tools (e.g., bots) to access the Services without permission.
We may monitor User Content and remove any that violates these Terms, but we are not obligated to do so.
6. Prohibited Activities
Violations may result in immediate account termination and legal action.
In addition to other restrictions, you may not:
- Use the Services to transmit harmful code, viruses, or destructive content.
- Engage in fraudulent activities, such as misleading redirects or click fraud.
- Violate privacy laws by collecting data without proper consent.
- Use the Services for high-risk activities (e.g., medical, financial advice) where failure could cause harm.
- Bypass security measures, such as rate limits, authentication, or API restrictions.
- Scrape, data-mine, or harvest data from the Services without authorization.
7. Intellectual Property
The Services, including all software, APIs, SDKs, documentation, designs, trademarks, and content, are owned by Linkzly and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
The Linkzly name, logo, and all related marks are trademarks of Linkzly Inc. You may not use our trademarks without prior written consent.
8. Disclaimers & Limitation of Liability
Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free, or secure.
Limitation of Liability
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Indemnification
You agree to indemnify and hold harmless Linkzly from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in Delaware, except for small claims or injunctive relief related to intellectual property. You waive any right to class actions.
10. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Your continued use of the Services after changes are posted constitutes acceptance of the new Terms.
